Conditions of the Equipments
All
new equipments & items come with Full Manufacturer’s Warranty. These
warranties vary on the brand and the equipment you purchase. Your Sales
Representatives can give you all the information on the warranty. All the
warranty issues on the new equipments & items should be solved with the
manufacturer.
We will gladly assist you with this process if you were to have any issues with
your new equipments & items.
All used equipment comes as-is, with no return, no warranty expressed or
implied.
We try to give our customers the best and the most accurate information on used
equipments.
However due to the age of the unit or the info plates missing on the equipment,
we can not guarantee the accuracy of this information. Our used equipment can
be inspected in our warehouse in Nashville,
TN.
There is no warranty on any used equipment for merchantability or fitness for a
particular use.
At Chefsdeal.com, we do our best to serve our customers with best high quality
used equipment.
All
the used equipments go thru a check up by our full time technicians, and go
thru a cleaning process.
However, we do not guarantee the used equipment to be in “Like New” condition.
Some or all used equipments may still need some detailed cleaning and some
minor repairs before they are completely ready to be put in service.
Accepted Payment Methods
We
do require the payment to be made in no more than 5 days. Please contact us if your will payment will
take more than 5 days for any reason. All items must be paid for in full before
any merchandise can leave our warehouse, or our manufacturer’s warehouse. At
Chefsdeal.com, we do accept all major credit cards, money order, cashier’s
check, Paypal, personal check, business check, Google
check out, and wire transfer. Some forms of payments, such as cashier’s checks,
personal checks, money orders, and business checks may slow down the shipping
process. The fastest payment methods are credit cards and Paypal
payments. All funds must be from U.S. Banks. We will only ship to confirmed Paypal Addresses to
protect our customers. Certain exceptions may apply. We also ship to Canada and we
do accept funds from Canadian Banks.

Purchases and Product Descriptions
If you wish to purchase any product made available through the Site, you may be
asked to supply certain information relevant to your purchase, including
without limitation your credit card number, the expiration date of your credit
card, your billing address, and your shipping information. YOU REPRESENT AND
WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER
PAYMENT MEANS USED TO INITIATE ANY TRANSACTION.
While Chefsdeal.com and our affiliates attempt to provide accurate information
on the Site, we do not guarantee that product descriptions or other content on
this Site will be accurate, complete, reliable, current, or error-free.
Descriptions and images of, and references to, products on the Site do not
imply our or any of our affiliates' endorsement of such products. We reserve
the right, with or without prior notice, to change such descriptions, images,
and references; to limit the available quantity of any product. Price and
availability of any product offered through the Site are subject to change
without notice. You agree to pay all charges that may be incurred by you or on
your behalf through the Site, at the price(s) in effect when such charges are
incurred, including without limitation all shipping and handling charges. In
addition, you are responsible for any taxes that may be applicable to your
purchases. Your sole remedy for the purchase of any product from Chefsdeal.com
through the Site is to return it for a full or partial refund as set forth in
the shipping contract governing such purchase.
Returns & Refunds
All
sales are final. There are no returns, refunds, or cancellations. Under certain
circumstances, Chefsdeal.com may make an exception and allow a return,
cancellation, or approve a refund. However, a restocking fee of 25% of the
total price will apply. Under certain
circumstances, the customer will be responsible for the shipping cost of the
returned item.
Packaging, Shipping and Handling
All
New Equipments are sold FOB our manufacturer’s warehouse or FOB our warehouse
located in Nashville, TN 37207.
All
shipping costs are for business locations. In some cases, certain locations
might be considered as residential area even though the shipment is made to a
business. In this case there will be slight difference in the shipping cost and
it will be reflected to the buyer.
We
ship most of our products via freight companies, using their standard rates.. Please
understand that the shipping amount calculated on our site is as accurate
an estimate as we can provide. However, the actual shipping costs may differ slightly.
Chef's Deal will be responsible for any shipping cost differences less than 10%.
If the difference to the actual shipping estimate is greater than 10%,
this difference will be reflected to your payment.
Chefsdeal.com
will accept no responsibility once your merchandise leaves our or
manufacturer’s warehouse. All Damage Claims will be handled by the customer and
the Freight Company. However, we will assist you with the paperwork and provide
you with the originals of the B.O.L. and the invoice.
Merchandise
located in our warehouse usually ships out in 5 business days, after the funds
clear (in many cases much faster). You will be notified once your merchandise
leaves our warehouse and you will be provided a tracking number. All inquiries
regarding the delivery should be made to the freight company after you are
given the tracking information.
Merchandise
being shipped from our manufacturer’s warehouse usually ships out in 3 business
days. However, certain items that might be out of stock can take up to 4 weeks
to ship. In this case, you will be notified with the estimated shipping date.
We will do the follow up and inform you with the tracking information once your
merchandise is shipped. We can not guarantee the shipping dates on the
equipment being shipped from our manufacturer’s warehouse.
Standard
Packaging of an item will be limited to the merchandise being placed on a
pallet, secured by straps, shrink wrap and / or bubble wrap, and necessary
labeling. Standard Packaging Will Not include additional crating, or boxes constructed.
These services are available at additional cost.
Insurance
is available for the items at additional cost shipped by Freight Companies. The
amount will vary depending on the value, size and the weight of your
merchandise.
The
delivery will be made to your curbside, and the buyer will be responsible to
move the merchandise to the desired location from the curbside. Some freight
companies offer inside delivery, residential delivery, and lift gate services
that can be purchased at an additional cost. The drivers are not required to
provide assistance for unloading your merchandise.
Items shipped within TN
will be subject to TN Sales Tax, which is 9.25%.
Customer Pick Up
Customer
pick up is available for the items that are located in our warehouse. There is
no additional cost for customer pick ups.
The
pick up times are Monday thru Friday 9:30am – 12:30pm CST. If you can not make
your pick up on the days and hours specified above, feel free to talk to your
Sales Rep. to make arrangements for a more convenient time for you.
Our
warehouse staff will help you loading your merchandise to your vehicle;
however, you will be solely responsible for securing your merchandise. We can
provide you with cardboards, Styrofoam and such, as they become available, but
we will not provide you any ropes, tie downs, bungee chords, and such.
Chefsdeal.com
will not be responsible for any damages to your merchandise, due to improper
loading, improper transportation, or loads not being secured well.
Special Note for Refrigeration Units
Refrigeration
units containing compressor, Freon and oil must be transported in Up Right
position only.
Tilting refrigeration units may cause the oil to leak in to the cooling system
and the unit may not function at all. Any customer asking a refrigeration unit
to be loaded in any position other than up right position takes the risk of the
unit not functioning at all when it is plugged in. Chefsdeal.com will not be
responsible for any damages that occur due to customer mishandling, or improper
transportation.
Please notify us in
advance if you have multiple items, or a large order to pick up from our
warehouse.
Please Note: Due to the limited warehouse
space, items that are not shipped / picked up in 10 days will be subject to
additional storage fees. The fee is $50.00 per item per month, and will have to
be paid in full before any merchandise can leave our warehouse.
Delivery
Chefsdeal.com
has its own delivery trucks and we do deliveries in the Middle TN area on a
regular basis. In some cases, we have performed deliveries with our own staff
to other states such as GA, KY, AL, MS, FL, SC, NC, LA and more. If you have a
large quantity order, delivery might be a better option for you then shipping.
Please feel free to discuss the details with your Sales Representatives.
Canada Shipments
Canada shipments are available for all
the merchandises that we sell. Shipping costs Will Not reflect the
brokerage fees and applicable taxes at the border. These expenses are the sole responsibility of
the buyer, and will be added to your shipping cost. If you would like to use
your own broker, you will be responsible for arranging all the shipment, and
notify us. The customer arranging their own shipment will be responsible for
faxing and / or emailing us a completed copy of Bill of Lading, and to give us
the necessary time to get the merchandise for shipment.
Special Note for Smallware Items
Items
from manufacturers Crestware, Libbey and Winco are considered smallware. Orders with a total
less than $250.00 from any of these manufacturers will result in a one time small order
charge of $25.00 for each manufacturer in the order below limit.
There are also
certain smallware items that come in cases which we cannot split, such orders will be processed as
if the full case is ordered and we charged accordingly.
Damage Claims
Once your item arrives,
check your shipment for possible damages. Chefsdeal.com will not be responsible
for any freight damages.
The National Claims Council Regulations specify that The Consignee must:
Ø Inspect shipment for possible for
concealed or unconcealed damages.
Ø If you feel like your item is
damaged (minor or major damage) have your driver mark
all Freight Bill copies as “Damaged” and have your driver sign them.
If
your shipment is believed to be damaged; Do Not Refuse the Shipment!
This will cause the shipment to go back to the consigner and you will be
charged for the shipping and a restocking fee. Accept the shipment and have
your driver mark and sign all the freight bills as “Damaged”. Immediately call
the freight company and ask for an inspection. Uncrate the shipment and check
for concealed damages. Keep all the packing material for the inspection as
well. If additional damages are found, please notify the delivering carrier
immediately. All Damage Claims must be made by the consignee. The shipper or
the manufacturer can not make any claims. The shipper is only responsible for
providing the necessary paper work for the consignee. Damage claims may take up
to 120 days. Please be patient and keep in touch with your carrier and remind
them to keep you updated on the case. Do not forget to check your shipment for
any missing parts. Claims for missing parts will not be honored if the claim is
made more than 15 days after the consignee has received the shipment.
Installation
At
Chefsdeal.com, we have our own full time technicians that do installation on
different kinds of equipment, such as Walk in Cooler / Freezer, ice machines,
fryers, stoves, furniture and more. We do service our customers in Middle TN
area. If you need installation on any of the equipment you purchase, please
talk to your Sales Representatives to find out how we can help you with the
installation process. No installation is included in the purchase price of the
equipment. Installations are performed at additional costs.
Site Conduct
You may not post or transmit on or through the Site:
- advertising or commercial
solicitations;
- promotional materials
relating to other Web site or online services which are competitive with
us and/or the Site;
- software or other materials
that contain so-called viruses, or other harmful or disruptive component;
- political campaign materials;
chain letters; mass mailings; spam mail;
- engage in any activity on the Site that
restricts or inhibits any other user from using or enjoying the Site such
as "hacking," "cracking," "spoofing," or
defacing any portion of the Site;
- harvest or collect information about
Site visitors or Members without their express consent.
- use the Site to defame, abuse, stalk, threaten
or otherwise violate the legal rights of others or for any fraudulent
purpose;
- create a database by systematically
downloading and storing Site content;
- frame or mirror any part of the Site without
our prior written consent;
- interfere with or disrupt the
operation of the Site or the servers or networks used to make the Site
available; or violate any requirements, procedures, policies or
regulations of such networks.
Other Issues
Chefsdeal.com reserves the right to change the terms and
conditions of these Terms of Use. You agree to review these Terms of Use
periodically to be aware of any such changes. Your use of certain services on
the Site may be governed by additional rules. We also reserve the right, at any
time, to change or discontinue any content or feature of the Site or any
services or products made available through the Site without notice. You agree
that we will not be liable for any modification, suspension or discontinuance
of the Site or of any service, content, feature or product offered through the
Site. Your continued use of the Site after such changes will indicate your acceptance
of such changes.
